Terms of Service

1. Acceptance of Terms

By accessing or using Quest2Query's services, websites, applications, or software (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you must not use our Service.

1.2 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service or via email. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Service Description

Quest2Query provides business intelligence and analytics services, including but not limited to:

• Data analysis and reporting tools
• Business intelligence dashboards
• Automated data processing
• Custom analytics solutions
• Integration with third-party data sources

3. User Accounts

3.1 Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

3.2 Account Suspension & Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms or applicable laws
• Engage in fraudulent or illegal activities
• Attempt to compromise Service security
• Fail to pay applicable fees

4. Payment Terms

4.1 Fees

Access to certain Service features may require payment of fees. All fees are quoted in Zambian Kwacha (ZMW) unless otherwise specified and are exclusive of applicable taxes.

4.2 Billing & Renewal

• Fees are billed in advance on a recurring basis (monthly/annual)
• Subscriptions automatically renew unless cancelled before renewal date
• We may change fees with 30 days' notice
• Late payments may result in Service suspension

4.3 Refund Policy

Refunds are issued at our discretion and subject to our Refund Policy. Generally, subscription fees are non-refundable except as required by law.

5. Intellectual Property

5.1 User Content

You retain ownership of data you upload to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive license to process and store your data to provide the Service.

Our Privacy Policy governs how we collect, use, and disclose personal information. By using the Service, you consent to our data practices as described in our Privacy Policy.

7.1 Data Processing Agreement

For business users, we offer a Data Processing Agreement (DPA) outlining our data protection obligations as a processor of your data. Contact us to request a DPA.

8. Limitation of Liability

8.1 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUERY2QUEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

8.2 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

• You may terminate your account at any time through account settings
• We may terminate or suspend access immediately for violations
• Upon termination, your right to use the Service ceases immediately
• Certain provisions survive termination (e.g., IP rights, liability limitations)

10. Governing Law & Dispute Resolution

10.1 Governing Law

These Terms shall be governed by the laws of the Republic of Zambia without regard to conflict of law principles.

10.2 Dispute Resolution

Any disputes shall first be attempted to be resolved through good faith negotiations. If unresolved, disputes shall be submitted to arbitration in Lusaka, Zambia in accordance with Zambian arbitration laws.
